Digital Millennium Copyright Act Compliance and Copyright Infringement Policy
1. Our Commitment to Copyright Protection
PrimePages ("we", "us", "our", or the "Website") respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond to clear notices of alleged copyright infringement.
This DMCA policy describes how copyright owners can report alleged infringements and how we handle such reports. It also provides instructions for users who believe their content was removed by mistake.
2. Reporting Copyright Infringement (DMCA Takedown Notice)
If you are a copyright owner or an authorized agent and believe that any content on our website infringes upon your copyright, you may submit a DMCA takedown notice. All notices must comply with the DMCA requirements.
To file a valid DMCA notice, you must provide the following information in writing:
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved).
- Identification of the infringing material that you request to be removed, including sufficient information to locate it (such as the URL of the magazine page).
- Your contact information: Name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature (typing your full name is sufficient).

3. Counter-Notification (If Your Content Was Removed by Mistake)
If you believe that your content was removed due to a mistake or misidentification, you may submit a counter-notification. To file a valid counter-notification, you must provide the following in writing:
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, the jurisdiction where we are located), and that you will accept service of process from the person who provided the original DMCA notice.
- Your physical or electronic signature.
Submit your counter-notification to the same DMCA Agent contact above.
If we receive a valid counter-notification, we will forward a copy to the original complainant. The original complainant will then have 10-14 business days to notify us that they have filed a court action seeking to restrain your infringing activity. If we do not receive such notice, we may restore the removed content.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.
We may also, at our sole discretion, limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
5. False Claims and Misrepresentations
Please be aware that under 17 U.S.C. ยง 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake, may be liable for damages (including costs and attorney's fees).
Think carefully before submitting a DMCA notice or counter-notification. If you are unsure whether material infringes your copyright, consider consulting with an attorney before submitting a notice.
6. How We Handle DMCA Notices
When we receive a valid DMCA notice, we will take the following steps:
- Review: We review the notice to ensure it complies with DMCA requirements.
- Removal: If valid, we promptly remove or disable access to the allegedly infringing content.
- Notification: We notify the user who uploaded the content about the removal and provide them with a copy of the notice.
- Documentation: We keep records of all DMCA notices for legal compliance.
7. Content You Upload - Your Responsibility
By uploading content to PrimePages, you represent and warrant that:
- You own the content or have the legal right to upload and share it.
- Your content does not infringe any third-party copyrights or other intellectual property rights.
- You accept full responsibility for any copyright claims arising from your uploaded content.
Uploading copyrighted material without permission is strictly prohibited. Users found uploading infringing content may face account suspension or termination.
8. Fair Use Notice
PrimePages respects the doctrine of fair use. Some content may be used for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. If you believe your use of copyrighted material qualifies as fair use, you should be prepared to defend that position.
